Tracey L. Young, RP  

Tracey Young, RP, past President of NFPA and CDPA, will provide an overview and discussion of select ethical issues relevant to paralegals working in New York.  She will review the NFPA Model Code of Ethics and Professional Responsibility and discuss several ethics opinions of the NFPA Ethics Board and New York State Bar Association Committee on Professional Ethics as follows:

  • NFPA Ethics Opinion No. 05-3: Is there a "published" rule on paralegals receiving part of settlements in cases?
  • NFPA Ethics Opinion No. 06-01 What means of compensation can a paralegal receive for referring business to their firm?
  • NYSBA  Ethics Opinion 1116 (3/29/17):  Nonlegal services, fee-sharing with nonlawyers, payment for referrals, billing practices, disclosing use of nonlawyer assistants, multidisciplinary practice
  • NYSBA Ethics Opinion 1121 (5/3/17)  Fee sharing between lawyers and nonlawyers; aiding the unauthorized practice of law
  • NYSBA Ethics Opinion 1132 (8/8/17)  Paying nonlawyers for a recommendation or referral

In addition to reviewing these topics, attendees will have the opportunity to discuss other ethical concerns they may have.

Approved for 1 hour of Ethics CLE credit by NFPA

Please note that your RSVP/registration is binding.  Cancellations must be received via email at CDPA.CLE@gmail.com by October 20.  Any no-shows or late cancellations are obligated, under CDPA rules, to reimburse the cost to CDPA’s Treasurer before the end of the month of the scheduled CLE.  Failure to reimburse CDPA will result in the denial of RSVPs/registration for any future CDPA sponsored programs or events until payment is received.
